The Reader
Rating: ★★★ Category: Movies Genre: Drama The Reader is a 2008 movie adaptation of a novel published in 1995 entitled "Der Vorleser" written by a German author Bernhard Schlink, who is also a law professor and a judge in the German justice system. The book won several awards and made it to the top of the elite New York Times Bestseller List. The film adaptation which was directed by Stephen Daldry (and top-billed by Kate Winslet of the Titanic fame) also received critical acclaim and was nominated in 5 Academy Award categories including the Best Picture category. It won for Winslet the Best Actress Award in the 81st staging of the Oscars (last February) and the Best Supporting Actress in the Golden Globe Awards for 2009. SUMMARY: Middle aged German barrister Michael Berg recollects to himself his lifelong acquaintance with Hanna Schmitz, a relationship with whom he never disclosed to anyone close to him. ReplyDeleteSa pagkaka-intindi ko, in libel cases, a primary element is malice. If the item written or in this case, posted, was deliberately meant to discredit or put the subject individual to ridicule or shame, then it's a strong libel case. Incidentally, there's a very good movie (starring Paul Newman and Sally Field) dealing on this subject - "Absence of Malice."

ReplyDeleteesp sa U.S. parang each and anything can be grounds for suing somebody..maski siguro you stepped on an ant in their yard...tch..sometimes feeling ko unreasonable na..takes the fun out of almost everything when you need ot mind everything ...
ReplyDeleteAnd Canada as well. Anything that happens on your property is your responsibility. Pag may pool ka at may nalunod, liable ka maski na uninvited yung taong nalunod. Pag may na-injured sa loob ng bahay or bakuran mo, responsible ka at pwede ka idemanda. Maski may madulas sa loob ng bahay mo, pwede ka rin idemanda. Pag may nag slip sa sidewalk sa harap ng bahay mo dahil hindi mo pinala ang snow, liable ka rin. And all these claims against you will likely be successful in court. Kaya nga dito, kelangan meron kang liability insurance. Otherwise you can lose your home kung may magdemanda sayo.
ReplyDeleteI really find that absurd. As there is caveat emptor or buyers beware, there should be visitors beware. I read that even a house thief (obviously uninvited and unwelcomed in one's house) was able to successfully sue the homeowner because he slipped in the house or something.
ReplyDeleteThat is true, unfortunately. Another example: if you have a trampoline in your backyard and your neighbor's kid sneaks in, uninvited, jumps on your trampoline, slips and breaks a bone, his dad can sue you and most likely will be successful. That's our sue-happy society at work.

ReplyDeleteEven worse is when you use your gun and fire a shot at the thief and hit him, you are the one who goes to jail, not the thief for illegal use of firearm, even though you have a license for that. Unless, the thief took the hostile approach first and you hit back, then it is self-defense.
